 Medical malpractice claims in Turkey have increased in last decades. The malpractice cases are mostly seen in state hospitals. The most common causes of these cases are negligence, inappropriate treatment and diagnostic failure.
In Turkey medical malpractice cases are tried according to criminal and civil law. The damage and death caused by medical malpractice is investigated by the Public Prosecutors in Turkish law. The prosecutors generally receive an expert report from any medical sources and if they conclude that there has been a reasonable doubt, they draft an indictment, and than the criminal case begins. If the medical staff are found liable at the end of the jurisdiction, it is sentenced to imprisonment or fined.
In criminal trials, asking for the opinion of the Council of Forensic Medicine is a must in cases of alleged medical malpractice. It is also the same in compensation trials.
